1) Overview

These Terms of Service (“Terms”) govern your access to and use of the Tandem Trips website and services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Eligibility & Territory

  • You must be at least 18 years old to use the Service.
  • The Service is primarily US-centric, but may be used worldwide where lawful. You are responsible for compliance with local laws.
  • Entities represent and warrant that the individual accepting these Terms has authority to bind the entity.

3) The Service; No Booking

  • The Service surfaces flight options for group travel from multiple departure airports and destinations using third-party data sources.
  • We do not book travel. We provide outbound links to third-party sites where you may complete bookings.
  • Prices, availability, schedules, and policies are controlled by third parties and may change without notice.
  • We do not guarantee any particular flight, fare, or outcome.

4) Payment & Charges

  • Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for applicable fees.
  • Pricing: $19 per 1,000 searches, rounded up to the nearest thousand. Taxes (if any) are included in the fee.
  • What counts as a “search”: The Service expands your inputs into combinations of departure airports × destinations × viable trip variants determined by your time windows and trip duration (see Policy page for details and examples).
  • No-result rule: If no valid result is found that meets all of your requirements, no charge is made.
  • Finality: If a search yields valid results, the related charge is final, regardless of whether you later book, cancel, or change travel.
  • All fees are in USD and are non-refundable unless otherwise required by law.

5) Accounts & Data

  • Current state: The Service presently does not create user accounts and does not store personal data beyond transient processing necessary to perform searches.
  • Future changes to account creation or data practices will be described in the Policy page and reflected in updated Terms.

6) Acceptable Use

  • No scraping, bulk exporting, or rate-limiting circumvention.
  • No reverse engineering, decompiling, or unauthorized access.
  • No use that violates law, infringes rights, or harms platform integrity.
  • We may suspend or terminate access for suspected abuse at our discretion.

7) Intellectual Property

  • The Service, including all software, UI, and content (excluding third-party marks/content), is owned by us and our licensors and protected by IP laws.
  • We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal purposes.
  • Feedback you provide may be used by us without restriction or compensation.

8) Third-Party Services

The Service links to or relies on third-party sites and APIs (e.g., airline/OTA sites, Stripe). We are not responsible for their content, accuracy, availability, or policies. Your use of third-party services is governed by their terms and privacy policies.

9) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ACCURATE, RELIABLE, OR AVAILABLE AT ANY GIVEN TIME.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TANDEM TRIPS NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

11) Indemnification

You will defend, indemnify, and hold harmless Tandem Trips and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or violation of these Terms.

12) Termination & Suspension

We may suspend or terminate access to the Service at any time for suspected abuse, legal risk, non-payment, or other legitimate reasons. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive (e.g., IP, payment, disclaimers, limitations of liability, arbitration).

13) Changes to the Service or Terms

We may modify the Service or these Terms. Material changes will be posted on this page with an updated effective date. Your continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.

14) Governing Law; Arbitration; Class Waiver

  • Governing law: Delaware law (without regard to conflicts of law rules).
  • Arbitration: Any dispute will be resolved by binding arbitration in Delaware, USA, administered by [AAA or JAMS] under its commercial rules. Judgment on the award may be entered in any court with jurisdiction. Either party may seek injunctive relief in court to prevent unauthorized use or IP infringement. You waive jury trial rights.
  • Class action waiver: Disputes must be brought individually and not as a class, consolidated, or representative action.
  • Opt-out: You may opt out of arbitration within 30 days of first use by emailing contact@tandemtrips.com with subject “Arbitration Opt-Out”.
  • Small claims: Claims may be brought in small-claims court in Tennessee, USA if they qualify.

15) Export & Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any country or region subject to U.S. sanctions, and that you are not on any U.S. government list of prohibited parties. You will comply with all applicable export, re-export, and sanctions laws.

16) Miscellaneous

  • These Terms constitute the entire agreement between you and us regarding the Service.
  • If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect.
  • You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Delay or failure to enforce any provision is not a waiver.
  • Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
